Using Recording Devices for Surveillance

While using recording devices is an effective way to catch a cheating spouse, it is important to use such devices in accordance with existing law.

Recording devices can range from computer monitoring software to hidden cameras and recorders to GPS tracking devices.

Several issues to consider when using any of these recording devices:

  • Legal to Purchase – It is LEGAL to purchase such devices. But once you purchase such equipment, you are responsible for using it in accordance with both federal and state law.
  • Ownership Matters – It is LEGAL to install recording devices on property which you own. You cannot install such devices on other people’s property.
  • Notification/Consent – Depending on the type of device being used and the state in which you live, notification or consent that a recording device has been installed may be required.

To be on the safe side, if you buy some type of recording equipment, check the manufacturer’s policy about using the device, or contact an attorney who is familiar with your federal and local laws and regulations.
